Devin Maduro & DeShawn Stoutt eligible for parole after @ least 30 years

ROAD TOWN, Tortola, VI – Justice Vicki Ann Ellis yesterday March 21, 2016 ruled on the parole eligibility of convicted murderers Devin Maduro and DeShawn Stoutt and the pair will have to spend between 30 and 35 years behind bars before being eligible for parole.

For Maduro, Justice Ellis ruled that he will be eligible for parole after serving 35 years and for Stoutt he will have to serve 30 years before being eligible for parole.

The two convicted men are both serving life sentences at Her Majesty’s Prison at Balsam Ghut on the Virgin Islands’ main island of Tortola.

Maduro was sentenced to life imprisonment for the July 23, 2004 murder of Anderson Paul and Stoutt was sentenced to life imprisonment for the January 25, 2007 murder of Godwin Cato.

Stoutt was sentenced in 2009 and Maduro in 2007.

DDP recommended between 25-35 years waiting period for both convicts

Representing the Crown, Director of Public Prosecutions (DPP) Wayne Rajbansie had said on December 11, 2015 that the Crown recommended between 30 and 35 years minimum waiting period for Maduro and between 25 and 30 years for Stoutt.

He had told Justice Vicki Ann Ellis that she should distance herself from any proposal to allow a first opportunity at a parole hearing after 12 to 15 years, noting that the VI should be emulating the British system.

Justifying his position, Rajbansie said that the two murders are not equal and noted that they should attract different times for first appearance for parole review.

Rajbansie had also slapped down the attempt by defence attorney Patrick Thompson, who used the argument that Maduro’s actions could be considered youthful folly. Rajbansie said that such a justification makes a mockery of the judicial systems set up to deal with youth or juvenile offenders, who are not as old as 25 years, the age Maduro was at the time of committing the offences.

The DPP said that from all indications Maduro has not taken any responsibility for the murder of Anderson Paul. He said this was the same with Stoutt with regard to the murder of Cato.

“Generally remorse calls for the applicants to accept that they are the ones responsible [for the deaths],” he said.
Rajbanse argued that catharsis is necessary for the two offenders and that time already served must be taken into consideration.

The two convicted murderers were represented by attorney at law Leroy Jones.

    To be completely honest, I am happy for them.. I personally feel that persons who are not cold blooded murderers, or persons who didn't have the intent to kill someone shouldn't serve life in prison. This is my opinion.!

He should have been made to serve 100 years before he came up for parole. He might be in the Holiday Inn on the hill but he is going to think about what he did everyday.

    everybody have a price to pay according to their actions. im pretty sure if the dead could talk they would ask to be alive again but they cant, so then the murderers need to pay their price n stay in jail. if u cant take the penalty don't do the crime.

    What I know here in the bvi is that people have their mouth to talk and fingers to type. So ago people could post all your stupid comments. Because in england who the bvi is under a person only spend 12 to 13years in prison so I don't understand how she get all the way up there. Everybody right now is glad that they got those numbers but when something like this hits close to home we will see how you feels about it.

    ffenders aged 21 years or over
    Where the offender is 21 or over at the time of the offence and the court takes the view that the murder is so grave that the offender should spend the rest of their life in prison, a 'whole life order' is the appropriate starting point. The early release provisions in section 28 of the Crime (Sentences) Act 1997 will then not apply. Such an order should only be specified where the court considers that the seriousness of the offence is exceptionally high. Such cases include:

    a) the murder of two or more persons where each murder involves a substantial degree of premeditation, the abduction of the victim, or sexual or sadistic conduct;
    b) the murder of a child if involving the abduction of the child or sexual or sadistic motivation;
    c) a murder done for the purpose of advancing a political, religious or ideological cause; or
    d) a murder by an offender previously convicted of murder.

    Where the offence is not so serious as to warrant a whole life order but the seriousness of the offence is particularly high the appropriate starting point is 30 years. The following examples are given:

    a) the murder of a police or prison officer in the course of his duty;
    b) a murder involving the use of a firearm or explosive;
    c) a murder done for gain (in the course of a robbery or burglary, or done for payment);
    d) a murder intended to obstruct or interfere with the course of justice;
    e) a murder involving sexual or sadistic conduct;
    f) the murder of two or more persons; or
    g) a murder that is racially or religiously aggravated or aggravated by sexual orientation.

    Where the offender the offender took a knife or other weapon to the scene intending to (a) commit any offence, or (b) have it available to use as a weapon, and used that knife or other weapon in committing the murder the normal starting point is 25 years. This increased minimum term does not apply in relation to a life sentence imposed for an offence of murder committed before 2 March 2010.

    For all other offences the appropriate starting point is 15 years.

      Those same scriptures also say if your right hand offends you to cut it off. The scripture also says in the commandments you should not kill then those same scriptures went on in Leviticus chapters 18-20 a whole different thing

      So what scriptures r u talking about. Anyway people have a right to feel the way they feel that is why when people go to court for any type of crime here they don't get off. The police don't lie and the victims don't lie.

    As I stated before is my opinion.. So it doesn't matter what you guys think. Tortola people just like to think that they better than everybody.. At the ending of the day these people have family who probably still care about them. When one of your love ones land in prison this is when you guys will shut up. I never said that they shouldn't pay for what they did, they should, But at the ending of the day i stand by my opinion and nobody can change that, who is you to judge my career interest. You should be saying from my comment it seems that I don't want to be a Prosecutor, But hey people who defend murderers make more money.. #backoff

    @spike. I have a question fo you r what lawyers do really? Who set presidents when it come to law. Even law makers in England and USA are changing the way of laws when it comes to murder. So why not follow suite. We say that we want to keep up with the rest of the world , so this is hjyst a small step
