deCastro flays Emancipation Festival; says it was a disaster!

ROAD TOWN, Tortola, VI – Outspoken Talk Show Host, Donald deCastro has taken the organizers of this year’s Emancipation Festival to task in announcing his displeasure at the way things were done.

Speaking during the introduction segment of his Straight Talk radio program aired last night, August 5, 2012, on a local radio station, deCastro said he felt the 2012 Festival was a “disaster”. He added that he would comment further on this matter in the month of September when more time becomes available.

deCastro also touched briefly on the issue of the Pier Port Project tender deadline being extended from today, August 16, 2012 to August 28, 2012.

Last night’s program centered around the issue of Landlords’ and tenants’ rights in tenancy agreements. The program’s guests were Sheryl Rosan of Rosan Law and Stacy Abel of Samuel Richardson & Co.

It was noted during the program that agreements are tailored not only for the tenant’s comfort, but also for the landlord’s protection, because at the end of the day, you don’t want tenants to come into your premises and destroy your premises.

This, it was said is a common aspect added to clauses in tenancy agreements to outline what is expected of tenants once they occupy a premises.

The program also discussed issues such as legal grounds for evicting tenants in addition to situations where landlords took matters into their own hands to get tenants to leave through extra-legal means such as disconnection of utility services.

    This man don't take part in a single thing, but always complaining. Who is suppose to entertain him. Why didn't he organize a float. The sad thing about it is that he can criticize well, but he offers no solutions. Poor fellow always - this is his way for seeking attention.

    I didn't listen to the show so I don't know what comments were made on the Landlord Tennancy issue, however, my opinion is that as the agreements are presently written up, only the landlord has protection. My concern is with the rights of a tennant, such as the landlord should NEVER be able to enter the rented premises without prior notice to the tennant. Further, the tennant should have the choice to be present when the landlord goes in. I've never had a serious issue but I know of times my previous landlord entered my premises without forewarning nor reason. His excuse was that I left my a/c on. My apartment, my bill, my choice. I also know landlords who have told me they have every right to enter an apartment belonging to them to check make sure it is being kept clean etc. I understand their concern, especially if they discover they have a slob for a tennant, however, they should be still required to notify the tennant 24 hours in advance. My next concern is with the slumlord, or the landlord who refuses to make repairs to the rental unit. Having to live with mold, rusted water pipes, a broken fridge or stove, leaks, infestation of bugs or rodents (not due to tennant) or any other that creates sub-standard living conditions is a breach of contract. The tennant should be able to give notice to move without any loss of thier deposit if the landlord has failed to address the problem and make the steps to have the problem rectified within a reasonable period of time. For apartments with utilities included the tennant expects to have the use of those utilities. Coming home on a Friday on a long weekend to discover you have no electrical power and have to spend a hot weekend with no a/c, running water or flushing toilets is not acceptable. The tennant should be able to check into a hotel or have their rent adjusted to not include those days. Also, the deposit should be returned to the tennant within a reasonable amount of time. Rent is due to the landlord by an expected date and the deposit should be returned similarly. On the same issue, any costs incurred that are attributable to the tennant, and payable out of the deposit should be supported with receipts and/or photos of before and after. In no circumstances should a landlord be able to scam a tennant out of their deposit. It was given under good faith and should be returned in good faith. My last issue is with the expatriate tennants that feel they are unable to do anything about any of the above issues. There is always a fear that angering a local landlord will result in Labor & Immigration being called and the tennant being removed from the island. No one should live in fear of standing up for thier own rights.

    I cannot comment on the rest of the festival as I only attended the RT parade which started late. Why don't the participants respect the starting time and why don't the organisers enforce it?..hope its better next year

    Not a thing was wrong with the festival. I enjoyed myself so ayo can stay there. Why ayo don't give thanks. people broke and ayo still complaining soooo.
