Danny Pemberton, Shamika Evelyn on gun/ammo charges
However, when it was time to plead the man, Danny Pemberton, pleaded guilty while his girlfriend pleaded not guilty.
According to the complaint before the court, on December 9, 2015 at about 5:50am members of the Royal Virgin Islands Police Force (RVIPF) swooped down on the home of Danny Pemberton and Shamika Evelyn in Sea Cows Bay with a search warrant.
On arrival, Evelyn answered the door. Pemberton was summoned and the police identified themselves. They were in plainclothes at the time, the court heard.
The warrant was read to Pemberton and he consented to his premises being searched. The premises is said to be a one-storey building with three bedrooms.
There were also two young children belonging to both the accused in the house at the time of the search.
The officers searched the bedroom used by Pemberton and Evelyn in the presence of Pemberton and a box was found on the floor next to a bed.
A search of the box allegedly released the presence of a black handgun later identified as a Glock .40. There were also nine live rounds in a magazine.
Pemberton was asked whether he had a licence for the gun and he allegedly responded that he did not.
Evelyn was then summoned to the room, cautioned and asked about the gun. She said that she did not know anything about it.
The court heard that other areas of the house were searched but nothing was found of evidential value.
At the conclusion of the search at about 7:55am, both Pemberton and Evelyn were transported to the Road Town Police Station where they were interviewed separately but both allegdly declined to answer questions.
Prosecuting for the Crown, Garcia Kirt Kelly said the Crown had no objections to bail for Evelyn as she had no antecedents.
The court heard that Evelyn is a mother of two children aged four and nine.
The court heard also that she was born on Tortola, resides in Sea Cows Bay and is employed at a day care centre and it was noted that a Glock isn’t something that ladies usually have as they are likely to prefer a small Beretta, to the amusement of the court.
Magistrate DaBreo set bail in the amount of $60,000 for Evelyn and a stipulation that she reports to the Road Town Police Station every Monday and Friday between the hours of 6:00 AM and 6:00 PM.
The matter continues on January 19, 2016 for Pemberton, who was remanded.

They need to add another 10 years jail time for child endangerment, having a loaded gun on the floor with children around is inexcusable
