Crown likely to drop charges against night club owner
When the defendant appeared before the court yesterday, March 24, 2014 for what was expected to be the start of his trial, the court heard that the Virtual Complainant (VC) was expected to be present to give a statement to the court but was absent.
James, who remains on $60,000 bail, has denied the allegations which stem from an incident in September 2013.
According to the allegations, on the afternoon of September 10, 2013 a female was standing along the roadway in Baugher’s Bay where she was trying to ‘catch a ride’ to work.
James allegedly stopped his vehicle and offered the woman a ride and she entered the vehicle.
While on their way towards Sea Cow’s Bay, James allegedly requested that the woman have sex with him. She reportedly turned down his request but the defendant allegedly offered her money which she refused.
Further, the defendant also allegedly tried to offer the VC a gift he had at the time, but she refused to accept it.
He then stopped his vehicle somewhere off the main road and continued his request. She reportedly declined again but he allegedly began to rub his penis, while using his other hand to touch the woman’s private parts.
At this point, the VC reportedly demanded that he take her to work.
James allegedly declined and said he would only do so if she let him to take a picture of her which she agreed to out of fear for her safety.
She was then dropped off to work and later reported the incident to the police.
The matter will come up for hearing again on April 4, 2014.
