Court of Appeal rejects Oliver J. Lewis bail application

ROAD TOWN, Tortola, VI – Stephen R. Daniels, the lawyer for Oliver J. Lewis, the Guyanese computer technician embroiled in child sex allegations yesterday April 6, 2016 sought to obtain bail for his client in the Court of Appeal but this was turned down on the basis of his not qualifying according to the set threshold.

The lawyer argued that his client should be given bail pending his appeal for which an application had been made back in December 2015. Daniels had also secured a stay of sentencing.

However, the Crown's contention was that there is no appeal because Lewis was not yet sentenced and also because he did not meet the threshold of exceptional circumstances among others.

Therefore, Lewis' case will be returned to the Magistrate's Court for sentencing at a date not yet known by this news site and he will remain in the custody of the State at Her Majesty's Prison at Balsam Ghut.

Back in December 2015, Daniels had filed an appeal which stayed Magistrate Ayana Baptiste-DaBreo from sentencing the 35 year old Lewis, who was in early December 2015 found guilty of four counts of gross indecency on a child under 14 years of age, allegedly committed between April and June 2013.

Bible sessions

The court heard on December 3, 2015 that the Virtual Complainant, aged 13 back in 2013, said he was engaged in Bible sessions with the male defendant.

The Magistrate maintained that whether or not the boy agreed to the alleged sexual activity, he could not give consent as he is a minor. The Magistrate said that the relationship between the VC and the defendant was described as a brotherly church relationship. It was revealed that on various occasions the defendant would allegedly pick the Virtual Complainant up from school and take him to his house where they would engage in homosexuality and paedophilia.

Texts & emails reveal much

There were many emails and text messages exchanged allegedly between the Virtual Complainant and the defendant. In some of them the defendant allegedly promised to buy the Virtual Complainant a cell phone. The Virtual Complainant allegedly preferred one kind over another and the defendant pleaded with him saying that he could not afford what the Virtual Complainant wanted.

In some of the texts, the defendant threatened to kill himself because of what allegedly took place between the two.

The Magistrate then went on to read out some of the allegations of sexual encounters between the defendant and the Virtual Complainant.

    Why does an innocent person have to spend so much time in Jail?. Isn`t the law says one is innocent until proven guilty. So anyone can accuse anyone of us of anything unproven and we live in Jail. How unfair doesn't matter where we are from, things can put in place to make sure the accused shows up for his say in court and be certain that justice is done either way.

      Did you even read the darn article? Oliver was found guilty in early December 2015 of four counts of gross indecency on a child under 14 years of age, allegedly committed between April and June 2013. He is waiting to be sentenced but his lawyer appealed the verdict which blocked the Magistrate from previously sentencing him. Schupes

      You can't read or what. The magistrate find the man guilty so he ain't no longer presumed innocent ...geez. The presumption of innocence is before you get convicted by the court or plead guilty. He was convicted so he's no longer presumed to be innocent. He is guilty and should be treated as such...until or if the Court of Appeal overturn the conviction. So jail is right where he needs to be....

    God please forgive me...But I'm glad. Let him sit in jail and think about what he did. Pure nastiness.. He should be happy that the BVI prison is not hard core like the prisons in other parts of the world where they rape child molesters on a daily.
