Cabinet approves Gambling (Gaming & Betting) Control Act 2020

- Bill gets First Reading in HoA: Sent to Select Committee

ROAD TOWN, Tortola, VI - The Virgin Islands Cabinet, chaired by Acting Governor David D. Archer, Jr in the absence of H.E. Augustus J. U. Jaspert on February 19, 2020, approved the Gambling Control Act 2020, which seeks to regulate gaming and betting industry in the Territory.

Bill approved in absence of Premier 

According to the post-meeting statements of Cabinet, they "Reviewed and approved the Bill entitled, Gambling (Gaming and Betting) Control, 2020, which seeks to provide for the regulation and control of gaming and betting and matters related thereto,' it said. 

The report indicated that all members were present, with the exception of the Premier and Minister of Finance, Hon Andrew A. Fahie (R1) and the Minister for Education, Culture, Youth Affairs, Fisheries and Agriculture, Dr the Hon Natalio D. Wheatley (R7).

In his November 14, 2019, Speech from the Throne, Governor Jaspert said the Government will be looking to push forward legislation to regulate the gaming and betting industry as part of its legislative agenda. 

Preventing criminal activities 

The Speech from the Throne is one from the government of the day where it noted that the legislation will, "provide for the establishment for the Gambling, Gaming and Betting Control Commission," to establish a licencing framework to prevent criminal activities. 

"The gaming and betting industry will, among other areas, cover sectors such as horse racing and the cruise industry," the Governor said in the speech, while noting that regulating the area will encourage revenues and provide local employment.

In the area of sports, the Governorin the same Throne Speechunderscored that there will be the introduction of the Horse Racing Act, 2001, to provide for the establishment of a Horseracing Commission to better regulate the sport, which is one of this Territory’s greatest past times.

Meanwhile, the Bill had its First Reading at the Fifth Sitting of the Second Session of the Fourth House of Assembly (HoA) on Thursday, February 25, 2020.

It has since been sent to a Select Committee for further deliberation.

    I’m not averse to legalizing gambling, for illegal gambling is already occurring, ie, racktrack betting, dice games, domino games, card games, cock fighting, dog fighting, USVI and PR lottery …….etc. Nonetheless, it must be acknowledged that gambling is a game of chance wherein the house always wins and people at the lower end of the economic ladder often times play the most and loses relatively the most trying to hit it big. What is next casinos, cruise liners being allowed to gamble within the territorial sea ( up to 12 nmi from shore), national lottery……etc

    Moreover, Gambling Commission members must undergo a strict and thorough criminal background check, and a thorough financial disclosure and interest check (all interest in assets must be disclosed) investigation. And Gambling Commission members must also be required to submit an annual financial disclosure statement to the Commission. The VI leak like a sieve in regards to protecting secret, sensitive and confidential information.

    Thus, personal financial information provided to the Commission must be protected and treated with the utmost care and only person(s) with a need to know should have access to the information. Commission members must see and don’t see and hear and do not hear. The information seen as a member(s) of the Commission should be treated with the utmost professionalism even after leaving the Commission;unless requested by a court of law, it should not be revealed to anyone and perhaps taken to one’s grave. There must be severe penalties for leaking private, sensitive and confidential information.

    This is just another inditement on NDP failures or lack of performance / vision. This is a great move. Now we have to make it happen. Making work... It's good for social gathering.. It's another Govt and businesses revenue earner .Pls. . Don't gambling what you can't afford to lose..... Kudos to VIP. I love the social life of public gaming.. Slash machines etc.

      Bahamas is holding a referendum on gambling legislation. This step has the capacity to change the BVI irrevocably - and not in a good way. Is it really consistent with the history and culture of this territory to have slot machines and casinos in the hotels, pubs and restaurants? Think carefully before embracing this Trojan horse. Oh, and casinos are a well known vehicle for money laundering and the BVI continues to walk a tightrope between the white list and oblivion. Be careful what you wish for.

    It is so really weird. It's like what is a hop bet in craps and I don't know what to do next. I really like to research some good materials about gambling but this law driving me nuts. I just want to play and I don't understand why did they restrict all rules about it?
