SLANEY, Tortola, VI- While the ruling National Democratic Party (NDP) regime of Premier and Minister of Planning Dr The Honourable D. Orlando Smith continues to be accused by the media, Town and Country Planning (TCP) and civil society of recklessly breaking the laws with its disregard for the Planning Act, it appears also that undue pressure is being placed on many local developers to comply with the same Act.

Government breaks the law & no one goes to jail

Recently, TCP confirmed that a beach project carried out by the Ministry of Natural Resources and Labour at Brandywine Bay was started without seeking planning approval, which was in violation of the laws of the territory. The TCP was forced to place a ‘stop order’ until such compliance of the laws was done. The Ministry has since complied with the laws and the project has restarted.

Last week the local media reported that a $325k road to the controversial BVI Ports Authority (BVIPA) Tortola Pier Park Project had started through the Ministry of Communications and Works. However, no permission was granted. The TCP has now confirmed that after the fact permission has been now sought and granted.

Local developer’s project put on hold

It is this news site’s understanding that a local investor, Mr Wilfred M. Smith, is building a restaurant and sports bar in the Slaney area of Tortola. However, it is reported that a stop order was issued to Mr Smith since the TCP allegedly wants him to give up a portion of his land for use by another person, by way of easement.

The portion of land in dispute is for a property owner to gain access to her property. Mr Smith argued that the portion of land is rightfully his and if the property owner wants to use the area in dispute to access her property he is willing to negotiate.

“The holdup is for me to give easement on my property to accommodate someone. I am prepared to obtain my property and let the person who wants to use my property come and negotiate with me not me go and negotiate with someone. If the Government made a mistake or failed to oversee in the future have me accommodated properly, monetarily. That is all I am asking,” a frustrated Mr Smith told Virgin Islands News Online.

He said it has been months that he has been trying to get his project going again but has not been given clearance by TCP.

Financial losses

Mr Smith said his project was scheduled to be completed in September 2015 and the delay is causing him to lose money. “I am $370,000 in the hole and am losing a significant amount of money with the project being at a standstill.”

Meanwhile, Chief Planner Gregory W. Adams told Virgin Islands News Online that the TCP had not issued a stop order on the project but that there are “some issues are to be resolved.”

“What do you say this letter is? Obviously I have been stopped because of the easement,” Mr Smith said, while producing the letter TCP sent to him.

Meanwhile, Mr Smith is also claiming that the main road along Slaney encompasses part of his land and he is seeking compensation from the Government for that.

No regard for the law?

A talk show host who did not want his named to be used expressed his displeasure over the state of affairs. “It’s clear that this government have no regard for the laws, the first week it was Kedrick Ministry, the second week Mark for not going through the proper channel….where is the Governor? Who is held accountable? The Planning Act is only for the poor man,” he alleged while raising his voice on the phone.

There are numerous local developers, on Tortola and some of the sister islands, who told our newsroom of the many times they was forced to make adjustments to their projects, costing them time and money, to comply with the TCP rules and the Public Works Department controlled Building Authority, however, it’s clear that the NDP government is a law unto itself.

      I give an easement by law in 2008 we are in 2015 and the person who I had to give it to come over on my land put wire and galvanize and up to this day the land registry have it up in limbo I told them I am going to fence what is legally mine and that person will not be able to use it they always putting things in place with out protection so MR SMITH if you have to give an easement be very careful.

      you a moo moo. He doesn't have to give nobody no easement over HIS land if he doesn't want to. Easement is not a law, but it is a land owner at his/her discretion, giving someone the right to pass over his land. No government can't force me to allow my neighbor to pass over my property if it is not a public right of way.

    the whole idea of the planning act is to make a better environment for everyone. No one is above the law, especially the government. A stop order just to get the formal paperwork is useless. there should be inspections and oversight, and penalties. Enforcement is a major step in educating the public to the rules, but they have to be even. I would think setbacks and heights so people can access their land and have a view are basic considerations. A friend had to sell her land in West End because the director of a government dept built such a large house, they had no access and had to sell their lot! This is not OK for the future of the island. Plus, local builders have to consider structural engineering and other factors when building, but they don't.

      Shouldn't TCP also be looking at land use? Isn't that sports bar and restaurant going in a neighborhood with homes? It's also in a place with a small public road. The building looks like it might be right on the street, with no set back. That's an area with hillside and cliff, so the road if it is to ever be widened would have to go into the hill side as it cannot go over the cliff; but it's also a place where everyone'sexisting homes and apartment buildings are right on the road with no where for the road to expand to meet the traffic demands. I have found that when commercial ventures are allowed in residential areas the business owners feel they have more right to do anything they want, like have music so loud you can't hear yourself think. They feel they are investors and so they have more rights because they have licenses to conduct business. But home owners are paying mortgages most of them, that's an investment too. And the right to live in your home comes with a occupancy permit, which is a license to live in your home and the entitlement to expect you can enjoy it. When you can't sleep in your house at night because someone's rights are greater than yours that's an infringement of rights. However, in the man's defense I think he's correct. The homeowner that needs access needed to get that sorted long ago. She just may have to pay some money for the privilege she's been freely enjoying all along, before the gentleman came along with his building. This is a pissing contest to see who is going to give in first. He'll have to do it if he wants to move on, otherwise he needs a really good lawyer to write a letter pointing out some basic facts to the TCP Board.

        This guy is obviously not paying attention to what's happening in the BVI. Nobody's going to frequent a restaurant/bar in that area with little or no parking right on the public road. It will end up being a run down spanish hide out and after a few years it will be turned into apartments to pay the mortgage. That is some good land there for a decent dwelling area or office space, not a restaurant/club.

          A restaurant on the side of a busy road opposite where the stink seaweed accumulates - good luck there buddy, but as someone else said it can always be turned into a Spanish bar or maybe even another stripclub. But not a restaurant.

    I don't know why some people think it is only rich white people who do as they please. There are plenty of locals who do as they please too. Think about it for a minute. Does the C*****s building ring any bells?

    It's all about who you are and who you for. Mr. Adams is just doing his job. Mr. Smith needs to allow the easement so he can move forward with his project.

      if you look to the rear of the property, there is a 260 feet retaining wall (no blocks). Not sure if you are a contractor or home owner....... do you know the cost of such a wall in this time?

    It needed to be stopped, it's a stupid idea to build a Restaurant and Sports Bar there in that area, not because you have a piece of land means you can build whatever, wherever. Build something else.. The location is not ideal for that venture.

        To @hmm.. Keep your insults to yourself, as everyone is entitled to their own opinions. I agree the Pub and other locations alike need to be moved as well, if they are a traffic hazard but that was then and this is now. Two wrongs don't make it right. If someone stood up when the Pub was building, it probably would've never been there... As that is not an ideal location for a restaurant either. However, my opinion is mine, just as your opinion is yours and I've never said he shouldn't build but think about your locations. Everybody seems to like this "crab in the bucket" comment, I guess it's trending and we know how you all love to be in thing and follow any and all trends.       Hmm@. What's wrong about it? I think its the perfect location. Buses with passengers always pull off the road to enjoy the view. They can pull into the restaurant have a drink. Have a bite while enjoying the view.. Also there is no congestion you can hardly get a parking spot when you going to a restaurant. Thats vision. Locals only see pull down. Tear down.

    So according to Adams there was easement via the "Old Public Road" which must be maintained. What I am getting here is that the development blocks an existing easement which must be maintained hence the request for a revised site plan. What exactly is the problem here? Just fix the plan and restart your project

      If an easement was previously registered against the property in Land Registry Department then there is an existing easement. If one is not registered then what you are saying is Mr Adams is telling tales.

    LoL!!! Yet another design that looks like A death trap. By the looks of this TCP need to examine their heads for passing the plans in the first place. Have they ever heard of an inadequate structure? Are you kidding me???? Who is the engineer/architect? Take him out to the fields and shoot them! If they survive shoot them again.

    The problem stems from allowing individuals that have neither formal education nor professional training pass as Architects and Engineers. It is CRAZY in regards to what a set of approved drawings looks like. I have seen a number of sets and have been amazed with what actually gets approved. I have not seen the drawings for this project but my Certified inspection experience and the picture tells me it is a death trap. The columns diameters are too small and the beams are inadequate for the long spans. Sadly you will see the full extent of the damage after a few earthquakes, loading of occupants,etc. A major earthquake will leave a building sandwich with its occupants as the center filling. Mark my word.
    So.... in my opinion TCP is handling things backwards. By the looks of it there are many more matters of concern that I see here than an easement. Logically speaking, if there is now (at this late stage) an issue with the easement how is it that the approval paper was issued in the first place? For those who can read (The image of the issued letter) read. It is evident that there was time (28 days) for the "agent/applicant" to revise the site plan. This is based on AMENDED drawings that were submitted on October 27 by Mr Scatliffe on the owners behalf. The letter was written 2 days later. IF it was a problem before that then how is it the Owner is 300K into his project. That tells me something changed recently.
    TCP either needs experienced plan reviewers or those that will apply the law equally regardless of WHO the applicants are. We all are in danger if they do not do their job.
